“Conflict
Metals“:『Don’t
Purchase And Use Conflict Metals』
In any
event shall the products supplied by the Company to
Flexium contain any metal of gold (Au),tantalum (Ta),
tungsten (W), Co, Pd or tin (Sn) (collectively
“Metals”), the Company declares and certifies that the
Metals are not derived from or sourced from mines in the
Eastern region of the Democratic Republic of Congo (DRC)
and surrounding countries (hereinafter “Conflict
Regions”) which are controlled by non-government
military groups or unlawful military factions (herein
after “Conflict Metals”).
The
Company commits that all information containing in the
reports, declarations and documents provided to Flexium
are completely true and accurate, and no fake or
omission is contained therein.
Upon
request by Flexium, the Company shall provide all
relevant documentation, certification and/or reports to
certify that the Metals on products are derived from or
sourced from the “conflict free”mines.
Company will defend, indemnify and hold
Flexium and its customers harmless for any and all
claims and liabilities, costs and expenses (including
legal costs and reasonable attorneys’ fees) relating to
or arising out of your Company’s non-compliance with any
above-mentioned commitments and/or any breach by you of
the terms of this Guarantee. |
